01

About these terms

Gray Gecko is the trading name of Marc Norris, a sole trader based in Pucklechurch, South Gloucestershire. In these terms “I”, “me” and “my” mean Gray Gecko, and “you” means the person or business buying from me.

These terms apply to the website design, build, hosting and care services I provide. They apply when you accept a quote, pay an invoice or start a subscription. If your written quote says something different, the quote wins for that point.

They are written for business customers. If you are buying as a consumer, nothing here takes away your statutory rights.

02

Quotes and pricing

The price builder gives an estimate. It becomes a fixed price when I confirm it in writing (an email is fine). A quote stays valid for 30 days.

The fixed price covers the pages and extras listed in the quote. Anything beyond that, such as extra pages, new features or a change of direction part-way through, is quoted separately before I do the work.

Prices are in pounds sterling. If VAT applies, it is shown separately on your quote and invoices.

03

Payment

Pay once. You pay the build price in full, on the payment schedule set out in your quote. A care plan is optional.

Subscribe. The build price plus 15% is split into 12 equal monthly instalments, rounded up to the nearest pound, and paid alongside your monthly care plan. For example, a one-page site at £249 is £24 a month for 12 months, plus the care plan. From month 13 only the care plan remains.

Invoices are due within 14 days unless your quote says otherwise. For late business payments I may charge statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and I may pause care plan services until the account is up to date.

04

Care plans

Care plans cover hosting and keeping the site running. They are billed monthly in advance.

  • Essential, £39 a month: hosting, ssl and backups; security and software updates; 30 minutes of changes each month.
  • Standard, £69 a month: everything in essential; 2 hours of changes each month; monthly traffic and search report.
  • Pro, £99 a month: everything in standard; 5 hours of changes each month; same-day replies; quarterly local seo review.

Included hours are for changes to existing pages and content. They do not roll over to the next month. New pages, new features and larger pieces of work are quoted separately.

If you subscribe, a care plan is required for the first 12 months while the build is paid. After that, and for anyone who chose pay once, a care plan runs month to month. You can cancel it at any time with 30 days’ notice by email.

05

Who owns the site

The site is yours once the build is paid for in full. That means the design, the content you supplied and the code I wrote for you, along with the domain, which is registered in your name.

Pay once: ownership passes when the build payment is received. Subscribe: ownership passes when the 12th build instalment is paid, or when the remaining balance is paid if you leave earlier (see “Leaving early”).

Third-party software, fonts, images and open-source libraries used in the site stay under their own licences. Until the build is paid, I keep the rights in the work and you have a licence to use the site while the account is up to date.

06

Leaving early (subscribe)

The build instalments are a way of paying for the build over 12 months, not a rental. If you cancel or stop paying before the 12th instalment, the remaining build instalments become due as one balance. Once it is paid, the site is yours and I will hand it over.

For example, leaving after month 1 on a one-page site leaves 11 instalments of £24, a balance of £264.

07

Handover

Handover means giving you the site files and content and helping you move the site to your own host. It is free once you have been on a care plan with me for 12 months or more.

If you chose pay once and have no care plan, or you leave a care plan before 12 months, handover costs a one-off £99. If you subscribed, there is no handover fee once the build is paid, however early you leave.

08

What I need from you

  • Text, images and other material when I ask for them, and feedback within a reasonable time.
  • That you have the right to use what you give me, and that it does not break anyone’s rights or the law.
  • Prompt answers to questions that block the work.

Timescales are estimates and depend on you providing material and feedback. If a project is stalled for 30 days or more, I may pause it, and work done so far becomes payable.

09

Revisions and sign-off

Reasonable rounds of revisions are included while I build the site. When you approve the site for launch, the build is treated as delivered. Changes after launch are covered by your care plan hours or quoted separately.

10

Cancelling before launch

Either of us can end a project by telling the other in writing. You pay for the work done up to that point, at the proportion of the build price it represents. Payments already made are not refundable to the extent the work has been done.

If you are buying as a consumer, you may have a statutory right to cancel within 14 days. That right is not affected by these terms, and you can ask me about it before you order.

11

How I use AI

I use AI tools to help design and build websites, which is part of how I turn work around quickly and help keep the cost down. I plan the work, review what the tools produce, test the site and approve it before it is delivered, and I am responsible for the finished site as if I had made every part myself.

I only put your material into AI tools where the project needs it. If something you send me is confidential and must not go into an AI tool, tell me before you send it and I will work around it.

12

Hosting and third parties

I use third-party services such as hosting, email delivery and analytics. I choose them with care, but they are outside my control, and I cannot guarantee uninterrupted availability. I will make reasonable efforts to keep the site running and to restore it quickly if something goes wrong.

Domain registration and renewal are paid to the registrar by you, unless your quote says otherwise. I do not promise particular search rankings, traffic or sales.

13

Portfolio

I may show the finished site and describe the project in my portfolio and marketing, unless you ask me not to.

14

Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

Otherwise, my total liability to you for any claim is limited to the amount you paid me in the 12 months before the claim, and I am not liable for indirect or consequential losses such as lost profit or lost business.

15

General

I may update these terms. The version in force when you accept a quote applies to that project; changes for care plans will be notified by email at least 30 days before they apply.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
